These Terms and Conditions ("Terms") govern your use of the PrimeBIM Philippines website (primebim.ph) and services provided by DSynths Philippines, Inc. ("we," "our," or "us"). By accessing or using our website and services, you agree to be bound by these Terms.

By accessing this website, you accept these Terms in full. If you disagree with any part of these Terms, you must not use our website or services.

2. Services

2.1 Service Description

PrimeBIM Philippines, operated by DSynths Philippines, Inc., provides:

  • BIM Training: Professional training programs on BIM software, methodology, processes, and collaborative workflows — including online, self-paced, AI-assisted courses with certification
  • BIM Consultancy: BIM implementation strategy, standards development, workflow optimization, and organizational BIM setup
  • BIM Outsourcing: On-demand BIM manpower solutions including staff augmentation, dedicated teams, and project-based deployment of vetted BIM professionals across all disciplines
  • BIM Tools & Resources: Productivity tools, templates, content libraries, and automation scripts

2.2 Service Availability

We strive to ensure continuous availability of our website and services, but we do not guarantee uninterrupted access. We reserve the right to suspend or discontinue services for maintenance or other reasons.

3. Use of Website

3.1 Acceptable Use

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

5.2 Confidentiality

  • We maintain strict confidentiality of client information and project data
  • Non-disclosure agreements (NDAs) may be executed for sensitive projects
  • We do not disclose client information without written consent

6. Outsourcing Services Terms

6.1 Engagement

  • Outsourcing services are provided under separate manpower or service agreements
  • Scope of work, number of personnel, disciplines, duration, and rates are defined in individual proposals
  • Both parties must sign an outsourcing agreement before deployment commences

6.2 Personnel and Conduct

  • All deployed BIM professionals are vetted and screened by DSynths Philippines, Inc.
  • The client is responsible for providing necessary project access, tools, and software licenses unless otherwise agreed
  • Deployed personnel remain employees or contractors of DSynths Philippines, Inc. and are bound by our conduct and confidentiality policies

6.3 Confidentiality

  • All project data, drawings, models, and client information handled during outsourcing engagements are treated as strictly confidential
  • Non-disclosure agreements (NDAs) are standard for all outsourcing engagements
  • Personnel may not share, copy, or distribute client data outside the scope of their assignment

6.4 Termination

  • Either party may terminate an outsourcing engagement with written notice as specified in the service agreement
  • Fees for work completed prior to termination remain payable

7. Training Services Terms

7.1 Registration and Payment

  • Training registration is confirmed upon receipt of full payment
  • Prices are subject to change without notice
  • All fees are in Philippine Pesos (PHP) unless otherwise stated

7.2 Cancellation and Refund Policy

  • Cancellation by participant: Full refund if canceled 14 days before training start date; 50% refund if canceled 7-13 days before; no refund if canceled less than 7 days before
  • Cancellation by PrimeBIM: Full refund or option to reschedule at no additional cost
  • No-shows: No refund for participants who do not attend without prior notice

7.3 Certification

  • Certificates are awarded upon successful completion of training and assessment
  • For self-paced online courses, certification is earned by completing the course and passing its assessments; for instructor-led or scheduled sessions, attendance of at least 80% is also required
  • Certificates are issued by PrimeBIM Philippines and are not official vendor certifications unless explicitly stated

8. Free Tools & Resources

8.1 License

Free tools and resources are provided under specific license terms included with each download. Generally:

  • Free tools are licensed for personal and commercial use unless otherwise stated
  • Redistribution or resale is prohibited without written permission
  • Modification is allowed for personal use only

8.2 No Warranty

Free tools and resources are provided "as is" without warranties of any kind. We are not liable for any damages resulting from their use.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount paid by you for the specific service
  • We are not liable for losses resulting from unauthorized access to your data or account
  • We are not liable for third-party content, links, or services

10. Disclaimer of Warranties

Our website and services are provided "as is" without warranties of any kind, whether express or implied, including but not limited to:
